Buying long guns out of state

My roommate is planning on buying a deer rifle for the upcoming season here. However, he is from New York(NY DL) but is a full time student here at ECU. Last year he was able to get a non resident student license to hunt but I'm wondering about him purchasing a long gun with a NYDL. Anybody know the answer to this?

yeah K train, thats what I told him as well. However, if his address changes it will affect his insurance and other stuff, so he doesn't want to go that route.

Stan, is that the case in SC or is it the same in NC?

I was in a store here in wilmington recently when they would not sell a shotgun to a customer who was a NY resident. He gave them the attitude you would expect, and in the end stomped out of the store, mad because he was a NY'er

I agree that you should have your friend get a local DL. I would not think that it would screw up his insurance. I wouldn't think the DMV is going to call everyone telling that he is officially a NC resident. Can he not get the NC ID and keep his NY liscense? ...I dunno, maybe?

or maybe look for someone who has upgraded and/or "clearing out the safe" and buy their deer rifle. I'll bet it would already be sighted in :thumbup1:

While I don`t think the feds prohibit it, NC law does. (I`ll have to check the book on the fed law when I get home tomorrow).........NC law allows for non-residents of "contiguous" states( SC, VA, GA, TN) to purchase in NC provided their state allows non-residents to purchase from contiguous states( contiguous states means states which NC shares a border with).

Unless it`s changed since I last read the law, NO a NY resident can`t buy a firearm of any type in NC, and take delivery. They can, however, pay for it and then have it transfered thru a NY FFL holder, then take possesion.

realistically, for car insurance he will probably drop his premiums a lot if he switches it to a NC license... this state has a much lower rate of theft and property crime than NY... unless he is from one of those way out of the way upstate places...

if the car is titled in NY and it is in a joint name like him and his father, then he can just keep it insured in NY... i didnt have any problems getting a NC license with FL tags and insurance still on my car... even after i put NC insurance on the car, it still took over a year before FL said i couldnt use their tag any more...

the NC DMV wont notify the insurance company of any changes...

contrary to popular belief he will not have to get anything insured or changed to NC (although that would probably be better for him in the event anything happened).

just because his license is in NC does not mean he has to carry insurance in NC. The car is not connected to the drivers license...

but as i just moved, i found that i 'should' carry MD insurance since i'm living in MD. being a student i'm not sure how NC would/could be more expensive than NY anyway.... claiming NC as residence over NY could save the guy some serious headaches in the long run.

one of my buds up here in MD recently went down to the beaches of NC/SC and was in some gun shops, since he was a MD resident (he admitted before he asked to hold the guns) they would not let him even hold a gun..... i know its crazy, but their shop, their rules

I'm thinking his insurance is probably health insurance from is parents. As long as he is listed as a dependent and full time student most will cover him till his mid 20's.
he can still get a NC drivers license and be covered under his parents. it won't matter as long as he is their child. Or he can do this: take a copy of his Lease in NC to the gun store and let them copy it. take school schedule, enrollment papers, etc.... everything that can prove your a resident.

the only thing that would possibly steer him away would be the NY license, if a NC dealer saw that he could possibly get scared bc of all the crazy ass new york laws

but still the NC License would be the way to go... or does NC give State ID cards, wouldn't be a license but he could still use it as a NC state ID w/ a NC Address on it.

You can get an ID from the DMV office usually I believe.

I know that I am ringing the same bell everyone else has, with a few exceptions, but in the end if he gets an NC ID or DL, he will be fine for buying the firearm. It proves residency. I don't care what other papers you have that prove you live here, lease agreements, bills, student schedules, car insurance, vet bill for the cat, doesn't matter. When I see the out of state DL, that ends the deal.

do you sell to military members who own residences in other states but are PCS to NC?? if i had a MD license but PCS orders to NC would i be eligible to purchase from you?

thanks guys...he is headed back home next week and I think heis going to pick one up there(NY) However, this is great information to know. He will be back down here for the fall semester so he will be able to use it then.
