Today House Majority Leader Skip Stam and Rep. Martin tried to ambush and STOP HB74 on the floor. If these guys are in your district, contact them immediately and let them know how you feel about their actions.

I would say LOUDLY tell them how you feel about this betrayal.

This was a result of the 5-3 vote today to get it out of the subcommittee. Looking for the official post from the state on the votes. I got this information from someone who sat in on the committee vote today.

Dems Glazier and Jackson were against as expected. Republican House Majority Leader Skip Stam ALSO against it which was the surprise. Martin worked with Stam to stall/stop this bill.
 
SB 34 has been amended to add the language of HB 74 and has already made it out of committee. A vote on the floor is expected soon.

ACT NOW: BILL HEADS TO FLOOR TOMORROW!
Under guidance from Grass Roots North Carolina, the Senate Judiciary II Committee today passed SB 34: "Castle Doctrine" in a stronger version which could ultimately create the most comprehensive such law in the country.

Thanks to the efforts of Sens. Buck Newton (R-, GRNC ****) and Andrew Brock (R-Davie/Rowan, ****), an amendment was made to the bill to incorporate most of the desirable features of HB 74, plus an added protection against crime in the workplace.

GRNC Legislative Action Team members were heavily involved in improving the language of the bill, drafting and reviewing sections, and providing information to sponsors and committee members.

Speaking on behalf of the bill were Sens. Berger, Clary, Daniel, Newton, and Tucker. Raising questions about the bill were Sens. Dannelly and McKissick. Sen. Berger initially offered an amendment to remove workplaces, but later withdrew the amendment and voted for the bill. SB 34 passed unanimously.

Improvements made to SB 34 include:
• Presumption of reasonable fear of imminent death or great bodily injury when an attacker makes an unlawful and forcible entry not only of a home, but also a motor vehicle and a workplace. Beyond including the carjacking protection long-sought by GRNC, this may be the first law in the country to include the workplace among protected areas

• "No duty to retreat" before using deadly force in anyplace the victim has a lawful right to be.

• Protection against malicious prosecution: Police may not arrest a victim forced to use deadly force unless they have probable cause to believe the use of force was unjustified.

IMMEDIATE ACTION REQUIRED

The bill will now head for a vote on the Senate floor as early as tomorrow. You must immediately do two things:

Dear Senator:

In its present form, SB 34: "Castle Doctrine" will deter violent criminals and give lawful North Carolinians the tools to defend their families against predators. Castle Doctrine reinforces existing law by stipulating that when faced with a reasonable fear of death or great bodily injury, crime victims have no duty to retreat before using deadly force in self-defense. It is critical that such protects exist anywhere the victim has a lawful right to be. The bill also creates a presumption of such fear if an attacker unlawfully and forcibly enters a victim's home, vehicle or workplace.

I strongly urge you to support SB 34, and to oppose any attempt to weaken the bill. I will monitor legislators' actions on the bill via Grass Roots North Carolina alerts.

According to the calendar HB74 wasn't supposed to be considered today.

But with all the games going on with those bills who knows, "support this one", "no wait, here's a better one" "nonono next week we're going to introduce another one that's better" I'm sure some of the members aren't really keen on all that.

Granted they have until may12 for one side or the other to pass something (crossover, at which point nothing new can be introduced for 2 years.).

Hopefully some (acceptable) version passes of course (as well as carry in restaurants)..though I would love to see some relaxing of the NFA guidelines in this state as well, but that's probably a bit much to ask for at this point.

The bill HB74 was in Judicial subcommittee B today. Unfortunately, they do NOT record the votes in the subcommittees that I can find. The SENATE subcommittee passed CD unanimously the House voted today and it was 5-3

To paraphrase a colloquialism, Republican House Majority Leader Paul Stam is trying to feed you manure by calling it a sandwich. As you recall, Stam led the attack against Castle Doctrine bill HB 74 in its House Judiciary subcommittee hearing. In relentless questioning apparently intended to tie up the bill, he painted scenarios of drug dealers shooting it out and using Castle Doctrine as a legal defense (this was rebutted by committee counsel), likening the bill to "expedited execution." Using phrases like "dead people on the floor" and "shoot first and ask questions later," Stam eventually produced handwritten language he claimed would accomplish "95%" of what bill supporters want.

Now the full proposal is out, and it is worthless. Not only does it fail to offer the presumption of reasonable fear of death or great bodily injury for victims whose homes, vehicles or workplaces are forcibly and unlawfully entered, the defense offered victims does nothing. Says the legal counsel for the legislature: "The State currently has the burden of disproving the defense, so the new subsection wouldn't change current law."

Do legislators think North Carolina gun rights supporters are stupid? Your proposal for HB 74 has all the appearances of a ruse designed to make North Carolinians think they are getting something to protect themselves against violent crime while, in reality, doing little or nothing at all.

Rest assured I will be monitoring your actions via Grass Roots North Carolina legislative alerts. Any vote for your proposal will be construed as anti-gun. Unless you want to put Republicans on the wrong side of a gun vote, as Representative Joe Kiser once did, I would suggest you shelve it and support HB 74 in its present version.

I am alarmed by Majority Leader Paul Stam's attack on Castle Doctrine bill HB 74. In the last election, Second Amendment voters supported new leadership because previous leaders worked to undermine gun rights. Indeed, gun owners were central to the transfer of power in both chambers of the General Assembly.

So imagine my surprise when a Republican and member of leadership began to attack efforts to bolster the ability of lawful North Carolinians to defend themselves against violent predators. Is this our reward? Representative Stam's proposal for HB 74 is nothing but a ruse designed to make gun owners think they are getting something when, in fact, it does little or nothing.

I look forward to telling family, friends and co-workers how leaders in both the House and Senate passed legislation to bolster the rights of North Carolina gun owners.

Sadly, House Majority Leader Paul Stam seems to have forgotten that Second Amendment supporters were instrumental in bringing a pro-gun majority to the General Assembly. He not only voted against the bill in its subcommittee, but now intends to offer gun owners a shell designed to create the impression of an effective bill while actually offering little or nothing.

A nearly identical bill just passed Second Reading in the Senate, attracting bipartisan support. I strongly urge you to contact Representative Stam and ask him to shelve his Proposed Committee Substitute. I will be monitoring this bill via Grass Roots North Carolina legislative alerts.

HEARINGS FOR PRO-GUN BILLS

HB 63 and HB 111 will receive hearings in the NC House Judiciary Subcommittee A on Wednesday, March 2. HB 63 will bar merchants and employers from prohibiting guns in locked vehicles. HB 111 was introduced at GRNC behest and will remove prohibitions on concealed carry in restaurants and municipal parks. Additional contact information for committee members will follow in coming days.

Also, why all the focus on H74? Most of the good stuff from H 74 was folded into the Senate bill. That bill has the stand your ground, work place and auto all covered.

My understanding is that the "alternative" being pushed by STAM, will essentially gut key portions of the CD law.The biggest being the civil liability. What is more concerning is that we should not be fighting STAM at all. He is supposed to be a Pro-2A and now he is siding with Anti-2A dems.

No offense to the NRA but I think they need to really look closer at STAM. I understand they are more national than local and are taking a more global big picture look but really as an NC resident, I think the civil liability immunity is a HUGE part to the bill along with the stand your ground provision. I think it is what NC residents deserve and I have honestly been a little bewildered at some of their (NRA's) stances lately. Would love to get some time with the NRA lobbyist to hear their side though.

What's to fight? There are two Castle Doctrine bills in a House Committee. Both are pretty similar. Stam has not put forward anything that is different.

What is Stam doing that is making you so mad? Be Specific - don't quote what some group says he's doing.

BTW, the NRA has a lobbist that only works SC and NC. He's pretty familiar with all the key players in both state houses.
 
Took a little time tonight to send my Senator an email. Since my rep is Sen. Berger I also included a small paragraph requesting he support the bill in it's current form (no more changes to withdraw the workplace option). I did not contact Sen Stam yet as I need to look further into his stance on the two different bills. Therefore I plan to call his office Monday and request a report on his position for both proposals.

Thanks for continuing to post up the info on Castle. I'll continue to send emails and make contacts to support the cause.
 
Here is Stam's cookie cutter response, undoubtedly he's gotten enough flack over this stunt to get some mail. FWIW, I don't trust it. We'll see.

Thank you so much for contacting Rep. Stam’s office. He is working to strengthen the existing Castle Doctrine. He wants the law to protect your right to defend yourself at home, in your car and in your workplace.


For your information, below is the current North Carolina law on the use of deadly physical force against an intruder. G.S. 14-51.1 currently states:

§ 14-51.1. Use of deadly physical force against an intruder.

(a) A lawful occupant within a home or other place of residence is justified in using any degree of force that the occupant reasonably believes is necessary, including deadly force, against an intruder to prevent a forcible entry into the home or residence or to terminate the intruder’s unlawful entry (i) if the occupant reasonably apprehends that the intruder may kill or inflict serious bodily harm to the occupant or others in the home or residence, or (ii) if the occupant reasonably believes that the intruder intends to commit a felony in the home or residence.

(b) A lawful occupant within a home or other place of residence does not have a duty to retreat from an intruder in the circumstances described in this section.

(c) This section is not intended to repeal, expand, or limit any other defense that may exist under the common law.


He is working with the bill sponsor of House Bill 74. He should be able to send you his ideas on how to strengthen the current law by early next week. What do you think?

Thanks for posting that info. Sounds to me like that was a "no news is good news" email. We are all very much aware of the current laws. This, at this time in my mind, does not sound as though Stam's camp is in favor of any new ligislation. We will just have to wait and see. I will call his office Monday and see what I get as a response, if any.
