So I just leased a new car a couple of weeks ago and after leaving the dealership, I noticed that the finance people forgot to list the annual allowable mileage and what the mileage overage charge would be per mile, both fields indicated N/A.
So I should have noticed this myself when signing however it was a long day and it was getting late, I missed it too. Anyway, we got a chuckle out of it since they failed to list an annual mileage and any over charge, heck they listed it, the just listed Not Applicable. We figured someone at the dealership or someone in finance would get a lecture over it. We also figured that they would be contacting us, and they did. Tonight we had a message asking us to come down and sign new paperwork.
Now I never go over my miles (12K per year) so the mileage in an of itself is no big deal, however I am inclined to leave them hanging. I know damn well that if the mistake was in their favor they would NEVER let me off, so why should I let them off the hook?
Does thinking that way make me a prick? I guess I just get kind of pissed at the way dealerships operate, all their sleazy tactics, but then then want me to run right over and help them fix their mistake. Its always a one way street with them.
My question is: What can they do? As far as I know the contract is binding, everyone signed off and I have had possession of the car since the end of March. Could they threaten to come take it? Can they even do that?
I am not saying that I will leave them hanging (I might) but I am curious. I think this creates an interesting legal question: Do they have any recourse? Can they force me to comply?
