Alright guys, I know previously NY residents could own preban magazines. I was contacted via email by a gentleman asking for preban AR mags. I was contacted through the gun classifieds website that Sore and Neo started up. With the new legislation in NY, can I legally sell 30 Round preban AR mags to a resident of NY? He is telling me that NY resident have until next January to surrender/destory/whatever their magazines. What are your thoughts on this? Legal or not?

So the fact that these are preban magazines is null and void. 30 round magazines are illegal period in NY state. Correct?
No. NY has it's own AWB that was in existence prior to the new laws that were enacted several weeks ago. Under the old NY AWB, possession of 10+ rd mags manufactured after 1994 is prohibited.

I think the recent law makes everything over 7rds illegal, with no grandfathering.

If you want to sell to a Commie state, sell to California - CA residents can buy disassembled 30rd mags.

yeah, avoid the states with restrictions at all cost.
Or just invest the time to learn the rules. More effort, yes, but may be able to get more for your stuff.

That said, NY seems like it's more trouble than it's worth. CA's rule is easy to understand.

lol, verifiable pre '94 mags were fine to sell to NY'ers. I did quite a bit of that last year trying to help out some family. a few had dates, a few manufactures were out of the game by '94 and after 94 all the mags had to be dated.

So undated or the ones with dates pre-'94 WERE legal to sell to NY residents. But with the new laws, I believe the cutoff was April to have them all 'disposed' of.

How the hell can you tell when a magazine was manufactured?
They used to have the dates stamped on them. The law is somewhat unenforceable with respect to undated mags, but I suppose they can look at the design to show that it is a post-94 mag.

Just noted this and figured it might be helpful on this thread:

This is from the Promag front page:

Upated New York Law: Promag Industries will be shipping 10 round magazines to anyone with a New York address until April 1st, 2013.

All that really says is they have read the law and decided it would be ok to ship until 4/1/2013... I figure they've probably done a ton of research since this is their business. Might be ok to follow them. They don't mention 30 round mags though...
