Okay, let's say you and your family are enjoying breakfast at IHOP when this happens. What would you do, if anything? If you normally don't carry into IHOP, then talk about what you would do when you aren't carrying. If you DO normally carry in IHOP, would that change your actions?

I'm not looking for what is right vs what is wrong. Just what YOU would do if this happened while you were there. If you never go to IHOP, pretend this is your favorite restaurant that does not serve alcohol.

Perfect example of sitting where I KNOW I can get out, i.e. fire exit or kitchen door, don't matter to me!!!!! The last thing I would do is sit there and watch these fools go at it, while waiting for chubby to decide to go for his gun.......

First, If I have my pants on, I'm armed ... and my pants are never far away, either. I take a gun with me when I am on the crapper in my own house (and alone).

Second, I'd tell the ghetto gang to take that shit to the Obama rally, just after I readied my weapon ... in case "mush mouth", there with the hog leg hanging out his baggy-assed pants, decides to bust a move.

Third, I may have just opened as a can of worms with the #2 above.

I am sure someone else has already called 911. I'll stay and advise my wife to low-run immediately to the door. I want to see how this crime wave plays out.

Of course, all the above is best case scenario ... the reality is that I don't know until it happens. Which IHOP might this have been at ... I'd like breakfast and a show. ;)

I would hope you had your pants on in IHOP.

Kidding aside i too would have my gun at the ready and be looking for the best way out.

Look around for the closest door. If ones not within 5', ask my server where they want one.

Holy crap I agree! What in the wide wide world of sports were all those people doing just SITTING THERE? GET OUT before you get a chair in the face!

I disagree with trying to get involved. Unless you or yours cannot escape, you will be better off somewhere else! Getting involved in a complicated scuffle like this is very treacherous. Who started it? Is the guy you're about to draw on the instigator or someone trying to defend himself? Little details like that are the difference between being a hero and a murderer.

I'm not saying to never get involved. In a clear cut Luby's Cafeteria type deal, get your gun out and shoot the #&$@ers to the ground!

But it's also true that you win every single gunfight you aren't in. :D

I agree, I would be leaving as soon as possible but probably with my gun already drawn. Don't think I would interfere unless me and my wife were in danger or perhaps one of the other people eating. And yes I would be carrying at that point.

I carry just about every place I'm allowed to, and since I avoid place I'm not allowed to as much as possible, that means I'd probabally have been carrying if I was there.

BUT......

You can't ALWAYS be carrying a gun.

Your brain, on the other hand, is always with you. (well, with most of us, anyway)

My wife has gotten used to me checking out where all the doors are and always sitting close to an exit and doing the best I can to never have my back to the main area. She expects it now and does her best to accomodate me.

In that situation, I'd like to think that I'd have begun removing myself and "my people" as soon as the disagreement looks like it might go wrong. I sure as hell would have taken my people out as soon as I saw dumbass with the gun in his pocket.

I like the statement I saw someone post earlier about winning every gunfight you avoid.

Under the NC CCH laws you can't do anything unless the violence is directed at you OR you know one of the "defendees", they (or you) didn't start it, and there is imminent danger of death.

Best advice is leave while calling the police WITHOUT drawing your gun, waving a gun around is going to cause everyone to panic needlessly and unnecessarily escalate the situation.

That would prob be a bad idea and might even get yourself shot. Unless anything was directed at you, I wouldn't even let anybody know I had a gun on me. They might think you're trying to be a hero and then you're the target, probably of both sides of that brawl.

Exactly

NC law 15A 401D2

it is reasonable to use deadly force to prevent yourself or a third party from what a reasonable person would believe to be the use or eminent use of deadly force or serious bodily injury.

Bear in mind (especially in the situation just shown): should you pull metal and come to the aid of the other party that is getting pummeled, are they going to stand valiantly next to you in court and explain why they are greatful that you stepped in and returned order to the situation?

...

...

no?

Ok then, so I would create as much safe distance that I can from the situation, and be the best witness that I can be when the police arrive.

I have a feeling that this Affray was quite mutual, and although I feel its my duty to protect people from undue harm, my BIGGER concern is if "I" escalate it with a firearm, now any shooting that occurs is "MY" fault.

I doubt that our fat Gangsta friend spends much time at the range, so he will likely just start spraying.

Not good to bystanders...

Now if the shooting starts, I'll do my best to end it, but hopefully my family and I are in a situation where I'm not jepordizing their safety by moving toward the violence as opposed to away.

I DO carry everywhere, even to the mailbox. :p

I DON'T take my radio with me, and if I don't have backup coming, then my concern is my loved ones.

I'm pretty sure deadly force is allowed to stop the imminent death or serious injury, regardless if you know the person or not

If I am in IHOP I am carrying and I am with my family. My wife would be carrying as well. I would escort them to the door. And make sure they are in the car safe and ready to leave, which means backing the car to a quick exit or even leaving if it looks that bad.

The next part is much harder to say. It depends on who is left in the restaurant if there are women or children I stay behind and make sure of there safety. I would not shoot of course until I thought that an innocent bystander was in danger or myself.

If a guy starts shooting in IHOP, as far as I'm concerned he's shooting at me.

Otherwise I mind my own business and clear out.
