Stolen Gun

I was making a purchase from one of our members, sent my payment ony to learn the day before it was to be shipped it was taken. Here is the PM I received.
Jonn I regret to inform you that I have some bad news, sometime during the night wed the kahr was taken from my truck while sitting in my yard. The only thing I knew to do was to promptly return your payment so today I returned your payment and ffl via certified mail you should have it in a day or two. I didn't know what else to do I apologize for the inconvience.
The pistol is a Kahr PM40 and was advertised as new in the box. If anyone hears of or has any information contact me by PM or at yankee2500@rtmc.net, or selkcip7 who should have the ser.#. The location it was taken from is Rutherfordton, NC.

good chance it has been found! just got a phone call from the parents of a local child (just through the woods) wanting me to come over and talk, ill give you an update as soon as i get back home. cross your fingers

if thats not your gun PM me the serial#. i live in rutherford county and am trading on guns all the time. and a guy came by the otherday with a cahr 40 but i was not interested and i think he still has it. and if its a match i will hold him till the law gets here and get it back to you. I HATE A THEIF

That is the logical answer but not the legal one . . .
safe storage law only applies to to you if you have minors living in your house... further it does not apply to minors that have committed a crime to obtain the gun...

§ 14‑315.1. Storage of firearms to protect minors. (a) Any person who resides in the same premises as a minor, owns or possesses a firearm, and stores or leaves the firearm (i) in a condition that the firearm can be discharged and (ii) in a manner that the person knew or should have known that an unsupervised minor would be able to gain access to the firearm, is guilty of a Class 1 misdemeanor if a minor gains access to the firearm without the lawful permission of the minor's parents or a person having charge of the minor and the minor:
(1) Possesses it in violation of G.S. 14‑269.2(b);
(2) Exhibits it in a public place in a careless, angry, or threatening manner;
(3) Causes personal injury or death with it not in self defense; or
(4) Uses it in the commission of a crime.
(b) Nothing in this section shall prohibit a person from carrying a firearm on his or her body, or placed in such close proximity that it can be used as easily and quickly as if carried on the body.
(c) This section shall not apply if the minor obtained the firearm as a result of an unlawful entry by any person.
(d) "Minor" as used in this section means a person under 18 years of age who is not emancipated. (1993, c. 558, s. 2; 1994, Ex. Sess., c. 14, s. 11.)

Well after arriving at the neighbors I found that it was my gun , the boy who was crying from what seemed to be a good old fashioned butt whoopin apologized and then was excused to his room. The father who is a prominent businessman and member of the community and also a good friend of mine wanted to make things right. the gun now damaged where he tried to bust the lock off could no longer be sold as new, I explained to him how I had it sold and was taking it off to ship the next morn he offered to pay replacement price and let me keep the gun if I didn't press any charges and assured me that he would take care of his child. I agreed he's a man of his word I knew he would take care of his son and his friends who may or may not have been involved. To make a long story short I got my piece back although in poor cond a check to cover the damage. And must important I learned a valuable lesson lock the stinking doors even in my own yard! And those metal trigger locks that come with the charter revolvers are undestructable . sorry Yankee hope you get your refund soon
Off to my gunsmith now to see if this thing can be repaired

Sure hope you find it. Best deterrent for a thief is 00 at close range and applied liberally. wc
that might be a little heavy. children make mistakes, if someone hit me with some 00 buck everytime i did something dumb as a kid... id look like swiss cheese.

although it was a pretty heavy crime, breaking into a car to steal a gun, i think it would be a case by case basis... possibly ruin a kids record for life and put a lot more stress on a family who is already going through some issues, or let him be and never learn from his mistake, maybe the parents are irresponsible and will let him continue this behavior. given the nature of the father being a stand up character, in this case i believe the OP made the right decision. good call.

then again if it happened to me, i might not be as level headed.

Hopefully, if his parents are anything like mine, and some of yours, he wont be able to sit down for week. mabey he needs some disipline and something in his life to make him become more reponsible. mabey we could help him out with that, just a thought.

My 2 cents: A father is usually MUCH better at handing out justice than our justice system.

The only concern is that "breaking into a car and stealing a handgun" is a big mistake. I understand not wanting to get the kid a 'permanent' record over this, but that kid should be your personal yard worker and car washer for a few weeks to make up for what he did in addition to [his father] simply fixing the pistol...

It's good to hear that you got your pistol back.
Even better to know that your neighbors are decent.
I hope that boy learns his lesson, cause that a rough path to go.
Lesson learned here is to keep everything locked up, even in the rural areas.
